Data Protection Information

The EU General Data Protection Regulation (GDPR), the regulation that determines how we are allowed to process your data, obliges us to inform you about how we will handle your personal data. We hereby happily fulfill this obligation:

Controller (person responsible) and purpose of the data processing:

The Polak & Partner Rechtsanwälte GmbH (FPLP), Am Getreidemarkt 1, 1060 Wien, datenschutz@fplp.at, is processing the personal data as the controller within the meaning of the GDPR. We will process the data exclusively and solely for contractual performance. Under no circumstances there will be any data processing for marketing purposes.

To whom we communicate your data?

In order to fulfill our contractual obligations it may be necessary to communicate your data to a third party (e.g. opposing party, substitutes, insurances, etc) as well as to courts and authorities.

How long will your data be stored?

We store your personal data no longer than necessary for contractual performance and defensive actions against possible liability claims.

What are your rights?

According to the GDPR you are entitled to the following rights:

Right to information: FPLP will inform you free of charge upon written request about the origin, the provenance as well as the recipient of the stored data and about the purpose of the data storage.

Right to data rectification: If you as the data subject (person concerned) encounter any wrong or inaccurate data, FPLP will rectify your data upon request at the earliest opportunity.

Right to erasure (data deletion): According to the GDPR the data subject (person concerned) under certain circumstances has the right to obtain from the controller the erasure of personal data, e.g. if you object or if on our part there is any unlawful processing of your data. The right to erasure can only be served as long as legal retention periods do not require otherwise or you did not assert claims against us.

Right to restriction of data processing: As data subject (person concerned) you are also entitled to request the restriction of the data processing. In this case FPLP will no longer use your data, with the exception of for instance evidence reasons.

Right to object/revoke: As data subject (person concerned) you are entitled at any time to revoke the permission of processing your data or to object it. The revocation of your permission/the objection does not make the already processed data unlawful. We would like to point out, that if you revoke your permission or object the processing of your data, we can no longer fulfil our contractual obligations.

Right of appeal to the Data Protection Authority: You have the right of appeal to the regulatory authority, if you suspect FPLP of not processing your data according to good faith.
